1. Who you are contracting with

PokerFace is operated by Zachary Scherer ("we", "us", the "Seller"). By creating an account or continuing to use PokerFace, you agree to these Terms & Conditions and enter into a contract with Zachary Scherer. If you use the service on behalf of an organization, you confirm you have authority to bind that organization; otherwise you confirm you are of legal age in your jurisdiction.

2. The service

PokerFace is an online reaction game: two players and a referee join a match, players pick photos for their opponent to react to on live camera, and the referee scores the reactions across six categories. Results, rankings, and cosmetic camera effects are recorded to your account.

3. Acceptable use

You must not misuse the service. This includes, without limitation:

• Using the service for anything unlawful, fraudulent, or deceptive.
• Uploading or showing content that infringes anyone's intellectual property, privacy, or other rights.
• Harassment, hate speech, sexually explicit content involving minors, or non-consensual imagery of any kind.
• Spamming other users or the platform.
• Interfering with the service's security or operation — including malware, probing, scraping, or attempting to bypass technical limits.
• Reverse engineering, reselling, or redistributing the service.

You are responsible for the photos you upload and how you appear on camera. You must have the rights to any content you upload, and you grant us a limited license to host and process that content solely to provide the service. We may remove or restrict content, refuse service, and suspend accounts that violate these rules. Rights holders may report infringing content via the contact details below; repeated infringement leads to account termination.

4. Your account

You must provide accurate information and keep it updated. You are responsible for keeping your account credentials confidential and for all activity under your account.

5. Intellectual property

We retain all ownership of the service and its intellectual property, including the software, design, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the service for its intended purpose.

6. Purchases, payments, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Cosmetic effects are one-time digital purchases delivered to your account immediately after payment. See our Refund Policy for how to request a refund.

7. Service level

The service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free performance, and we disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law. Live video depends on your own device, browser, and network.

8. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When your access ends, your uploaded photos and account data may be deleted after a reasonable period.

9. Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Our aggregate liability is capped at the fees you paid us in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where the law does not allow it.

10. General

You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not responsible for failures caused by events beyond our reasonable control. These terms are governed by the laws of the Seller's jurisdiction, and disputes will be resolved in its courts. If any clause is unenforceable, the rest remain in effect.
